رسالة علمية في تخصص الشريعة ( أصول الفقه ) عن المسالك والطرق التي يسلكها المجتهد لمعرفة علة الحكم الشرعي في الأصل حتي يبني عليها الفروع. تناول فيها الباحث القياس باعتباره الدليل الرابع من أدلة الأحكام الشرعية وتطرق إلي أهم أركان القياس وهو العلة فهي الجامع بين الأصل المنصوص عليه والفرع الذي لم ينص على حكمه، ومن ثم الطرق التي يسلكها المجتهد للتعرف على تلك العلة الجامعة بين الأصل والفرع.
Abstract
A scientific thesis in the specialization of Sharia (Fundamentals of Jurisprudence) on the paths and methods that the mujtahid takes to know the reason behind the legal ruling in the original in order to build upon the branches. The researcher dealt with measurement as the fourth guide from the evidence of legal rulings, and he touched on the most important pillars of measurement, which is the illness, because it is the one between the stipulated principle and the branch that did not stipulate its ruling, and then the methods that the mujtahid takes to identify that common cause and the branch.between the original
