موضوع هذهالدراسةهوخصوصية ارتكاب الجريمة السيبرانية في النظام المعلوماتي، فلابد من البحث في ماهية هذه الجرائم ومدى فعالية القوانين الوطنية في مكافحتها؛ ويتجلى ذلك من خلال اعتماد دراسة تحليلية على ضوء النصوص التشريعية الواردة في القانون الجزائري، عن طريق البحث في الإطار المفاهيمي المنظم لأحكام الجريمة السيبرانية، ثم تحديد مختلف التهديدات القانونية المميزة لقيامها في الفضاء الافتراضي باعتبارها من الجرائم الناعمة التي تقوم بواسطة استخدام برامج معلوماتية في أجهزة الحاسب الآلي يترتب عنها إلحاق أضرار بالأفراد والمؤسسات العامة والخاصة، مما فرض على المشرع حتمية التدخل بنصوص تشريعية مستحدثة لمكافحتها وتوقيع العقوبات على مرتكبي الجرائم السيبرانية.
Abstract
The subject of this study is the peculiarity of committing a cyber crime in the information system. It is imperative to research what these crimes are and the effectiveness of national laws in combating them. This is evidenced by the adoption of an analytical study in light of the legislative texts contained in the Algerian law, by researching the conceptual framework governing the provisions of cybercrime, and then identifying the various legal threats that are characteristic of their existence in the virtual space as they are soft crimes that are carried out by using computer programs in computers. The mechanism has resulted in damages to individuals and public and private institutions, which imposed on the legislator the inevitability of interfering with new legislative texts to combat it and impose penalties on the perpetrators of cyber
