تعد ظاهرة اختطاف الأطفال من الظواهر الإجرامية الخطيرة، التي أصبحت تؤرق المجتمع الجزائري وتهدد استقراره وأمنه في وقتنا المعاصر؛ لكونها حديث الساعة التي شغلت العديد من الباحثين والدارسين في علم الاجتماع والسياسة والفقه الإسلامي، كل في محيطه وتخصصه.
لذلك جاءت الشريعة الإسلامية لحفظ الضروريات الخمس، والتي هي: الدين،العقل، النفس، النسل، المال، كما أن موضوع الاختطاف اليوم قد تعددت أشكاله وأعراضه، وجدت فيه نوازل هي بحاجة إلى البحث وبيان الحكم الشرعي فيها. خاصة للقاضي وذلك لما يشهده هذا الوقت من كثرة حوادث الاختطاف وتنوعها والتي وصلت إلى التطاول على المسالم، مما يترتب عليه إخلال بالأمن، وقد أوردت بعض اللجان المتخصصة نِسَبا مرتفعة في جرائم الاختطاف وكثرته في السنوات الأخيرة، مما يؤكد أهمية الموضوع واستحقاقه للبحث، وبالتالي فإن معالجة مثل هذه القضية وبيان حكمها الشرعي لهو من اجل المقاصد الشرعية.
Abstract
The phenomenon of the kidnapping of children is considered one of the dangerous criminal phenomena that have become troublesome to Algerian society and threaten its stability and security in our contemporary time. Because it is the talk of the hour that occupied many researchers and scholars in sociology, politics and Islamic jurisprudence, each in his surroundings and specialization.
Therefore, Islamic law came to preserve the five necessities, which are: religion, reason, soul, birth, money, and the topic of kidnapping today has many forms and symptoms, and I found in it calamities that need to be researched and the Sharia ruling is explained in it. Especially for the judge, due to the large and varied incidents of kidnapping witnessed at this time, which reached an insult to the peace, which leads to a breach of security, and some specialized committees have reported high rates of kidnapping crimes and their proliferation in recent years, which confirms the importance of the topic and its worth to research, and therefore the treatment of Such a case and the statement of its Sharia ruling is for the sake of legitimate purposes.
