الملكية الفكرية هو مصطلح شامل يحدّد ويعرّف الحقوق والحماية لأملاك فكرية غير محسوسة من مؤلفات، ابتكارات، تصاميم وغيرها من أفكار ذاتية نابعة من صاحب هذه الملكية الفكرية، وتتطرّق الحماية الفكرية بواسطة الملكية الفكرية بصورة أشمل للعمل الفكري نفسه وليس تحديدا فقط للشيء المادي أي ليس تحديد لآلة معينة التي تم إنتاجها حسب تفصيل اختراع معين (بل للابتكار الفكري نفسه الذي هو ثمرة الجهود التفكيرية الذاتية للمخترع والتي من خلالها بُنِيّت تلك الآلة).
ليست جميع الأفكار بالضرورة تنتمي للملكية الفكرية والى شخص محدّد بل معظم الأفكار، المعلومات والاكتشافات في العالم لا تنتمي إلى شخص معين، ويمكن استغلالها بشكل حر من قبل الجمهور، فقط تلك الأفكار التي تستحق الحماية الفكرية تكون حصرية لمبتكريها أو لمن حُوّلت له حقوق استخدامها وتكون ملكيتها محمية لفترة محدودة.
Abstract
Intellectual property is a comprehensive term that sets and defines the rights and protection of intangible intellectual property of literature, innovations, designs and other subjective ideas emanating from the owner of such intellectual property. Intellectual protection is more broadly addressed by intellectual property than the intellectual work itself, and not merely a definition of the physical object, ie, no identification of a particular machine produced according to the details of a particular invention. (but for the same intellectual innovation, which is the result of the inventor's own thought efforts through which that machine was built).
Not all ideas necessarily belong to intellectual property and to a specific person, but most ideas, information and discoveries in the world do not belong to a particular person and can be freely exploited by the public. Protected for a limited time.
