تناولت ھذه الدراسة الإضراب عن العمل دراسة مقارنة بين القانون والفقه الإسلامي، هادفة إلى بيان رأي القانون والفقه الإسلامي فيھا، وقد تم الوقوف على ماھيته ومقوماته وموقف القانون والفقه منه؛ فتبين أن الحق في الإضراب حق أصيل ومكفول في المواثيق والعھود الدولية كما ھو كذلك في الوثائق الدستورية الفلسطينية ،وظھر أيضا أن قواعد الشريعة الإسلامية ً ، ومقاصدھا العامة تحث على تحصيل الحقوق وتحقيق العدالة لعموم المكلفين، ومن ذلك إضراب العاملين عن العمل للمطالبة بحقوقھم، ومن خلال الوقوف على ھذه المحددات وما يتعلق بذلك؛ أمكن القول بأن الإضراب عن العمل ليس مقصودا لذاته ً ً وإنما لكونه وسيلة ً موصلة إلى حاجات الإنسان، وبالتالي فھو مشروع إذا روعيت شروط القيام به
Abstract
This study addressed the issue of going on strike, exposing the opinion of law and Islamic Fiqh (Islamic jurisprudence) on it. The focus was on the nature and foundations of strikes and the standpoint of law and Fiqh. It has been revealed that striking is an original right that is guaranteed by international agreements and covenants, as well as by the Palestinian constitutional documents. The study also showed that the Islamic Shari’s rules and goals urge that the rights be granted and justice done for all, among which is workers’ strikes for the purpose of demanding their rights. Through studying these determinants.
