تثير مسألة المسؤولية حول الغازات الدفيئة في القانون الدولي للبيئة العديد من الإشكاليات نظرا لارتباطها بالمصالح الاقتصادية للدول. فإرساء قواعد الإنصاف في العلاقات الدولية أصبح ضروريا لتمتع الدول بنفس الظروف لتحقيق تنميتها، و لتحمل كل دولة مسؤوليتها بحسب مساهمتها في التلوث و بحسب إمكانياتها المادية و التكنولوجية. فمن غير الممكن المساواة بين الغازات المنبعثة حاليا من الدول المتقدمة و تلك الغازات المنبعثة من الدول النامية، فظروفها الاقتصادية و الاجتماعية تجعل مستقبلها يتوقف على الزيادة في هذه الانبعاثات. و قد بذلت العديد من الجهود الدولية لتحديد مسؤولية الدول حول الغازات الدفيئة، و تقوم كل هذه الجهود على مبدأ أساسي و هو مبدأ المسؤولية المشتركة و المتباينة.
Abstract
the issue of liability for greenhouse gases in international environmental law raises many problems because it is linked to the economic interests of states. The establishment of justice and morals in international relations is essential for states to enjoy the same conditions to achieve the development. Each country is responsible according to its contribution to pollution and its financial and technological capabilities. It is not possible to equate the gases emitted from developed countries and those emitted from the developing countries, their economic and social conditions make their future dependent on the increasing in these emissions. Many international efforts have been made to determine the responsibility of states for the greenhouse gases. All these efforts are based on a fundamental principle; common but differenciated responsibility.
