إن دسترة الحق في بيئة نظيفة و صحية هي خطوة هامة في سبيل التمكين من هذا الحق، خاصة و أّن
الدستور هو أعلى القوانين. و على ذلك فإّن الدسترة لهذا الحق في تزايد مستمر نظرا للوعي العالمي بأهمية
البيئة. كما أّن القانون الدولي للبيئة أثبت عدم فعاليته في كفالة الحق في بيئة نظيفة و صحية في العديد من
الأوساط البيئية، و هو ما يجعل القانون الداخلي أحد الحلول لحل المشاكل البيئية.
Abstract
The constitutionalizing of the right to a clean and healthy environment is an
important step towards the empowerment of this right especially that the constitution
is the highest law. The constitutionalizing of this right continues to increase due to
the global awareness of the importance of the environment. In addition, the
international environmental law has proved it’s ineffectiveness in ensuring the right
to a clean and healthy environment in various environmental media. It is what makes
the domestic law one of the solutions to solve the environmental problems.
