نهدف من خلال دراستنا لموضوع"الإجراء المستحدث في البحث والتحقيق للكشف عن الجرائم المرتكبة في الفضاء الإلكتروني"إلى معرفة الإطار المفاهيمي لإجراء المراقبة الإلكترونية من خلال التطرق لتعريفه وخصائصه،إضافة إلى التطرق لشروطه وأطراف المراقبة الإلكترونية،كما نهدف أيضا إلى معرفة دور إجراء المراقبة الإلكترونية في الكشف عن الجرائم السيبيرانية،وذلك من خلال التطرق لضوابطه وحالات اللجوء إليه،إضافة إلى معرفة مشروعية إجراء المراقبة الإلكترونية من خلال ما جاء في الدستور الجزائري وفي قانون الإجراءات الجزائية الجزائري.
Abstract
Though our study of the topic the procedure developed in research and investigation to detec crimes committed in cyberspace,we aim to know the conceptual framwork for conducting electronic monitoring,by addressing its definition and characteristics,in iddition to addressing the conditions and parties to electronic monitoring,and we also aim to know the role of the monitoring of procedure in the detection of cyber crimes,by addressing its controls and cases of resorting to it,in addition to knowing the algerian constitution and the algerian code of criminal procedure.
