تعرُّضت الاصناف الزراعية المبتكرة الى الاعتداء من قبل الغير , سواء على الصنف نفسه أو على حق ملكيته وتمثلت صور الاعتداء على الأصناف الزراعية بالقرصنة البيولوجية , أي الاستيلاء على المعارف التقليدية أو الأصول البيولوجية والاعراف السائدة في البلدان الأخرى , واستغلالها في الحصول على الأصناف الزراعية وتسجيلها دون موافقة أصحابها , والمنافسة غير المشروعة , كانتهاك المعرفة التقنية , أو التقليد.
ونتيجة لما تقدم , سارع المجتمع الدولي الى وضع السبل الكفيلة بالحد من تلك الاعتداءات , فوضعت الكثير من الاتفاقيات , وكان من بينها اتفاقية تربس التي نوهت عن أنظمة الحماية المنحصرة ما بين نظام براءة الاختراع والنظام الفريد الفعال والنظام المختلط للحماية , فتباينت الدول في اختيار نظم الحماية للأصناف الزراعية.
Abstract
Innovative agricultural varieties were subjected to abuse by others, whether on the variety itself or on its ownership right, and the forms of assault on agricultural varieties were represented by biopiracy, that is, the appropriation of traditional knowledge or biological assets and norms prevailing in other countries, and their exploitation in obtaining and registering agricultural varieties without consent Owners, and unfair competition, as the violation of technical knowledge, or imitation.
As a result of the foregoing, the international community was quick to lay down the means to limit these attacks, and many agreements were drawn up, among them the TRIPS convention , which referred to the protection systems confined to the patent system, the unique effective system, and the mixed system of protection.
