يعتبر الطرد جزاء أو إجراء وقائي توقعه المنظمة الدولية الحكومية ضد الدول الأعضاء بها لإنهاء صفتها القانونية نهائيا، وفي هذا السياق تهدف هذه الدراسة إلى معالجة اشكالية تتمحور حول أسباب طرد الجمهورية الصحراوية من الاتحاد الافريقي. فالجمهورية الصحراوية أو بالأحرى جبهة البوليساريو كيان لا يتوفر على سمات الدولة ذات السيادة، بل عامل مزعزع لأمن المنطقة واستقرارها، ساهم الاعتراف الدولي به في توتر وجمود العلاقات الثنائية للمغرب مع بعض الدول والمنظمات الإفريقية. وفي الأخير خلصت هذه الدراسة إلى أنه يجب على الاتحاد الافريقي ممارسة الضغط على الجمهورية الصحراوية للانسحاب وفق الاجراءات القانونية، أو تعديل القانون التأسيسي للاتحاد الافريقي بهدف النص صراحة على طرد واستبعاد الدول الاعضاء كإجراء جزائي او وقائي.
Abstract
Expulsion is considered a sanction or a preventive measure imposed by the international organization against its member states to permanently terminate its legal status, In this context, the This study aims to examine the reasons for the expulsion of the Sahrawi Republic from the African Union, the Sahrawi Republic or rather Polisario Front it has no features of a sovereign state, it the which is a destabilizing factor for the security and stability of the region, Its recognition contributed to the tension Morocco's relations with some African countries and organizations are tense. finally, this is study concluded that the African Union must pressure sahrawi republic to withdraw in accordance with legal procedures, or submit proposals for the amendment of the AU Constitutive Act, adding the expulsion of member states as a sanction or preventive measure.
