إن أصل فكرة التقنين قديمة وليست وليدة الساعة وليس بحثها وتوضيح القول بها بدعا من القول , فقد أشير بها في عصر الخليفة العباسي أبو جعفر المنصور ثم تحولت هذه الفكرة حقيقة في عصر الخلافة العثمانية وجرى تطبيقها عمليا عبر أول تقنين في مجلة الأحكام العدلية في أواخر عهد الخلافة العثمانية
وقد جرى الخلاف في شأن تقنين أحكام الشريعة الإسلامية بين الفقهاء , فذهب البعض إلى جوازه وساقوا بذلك أدلة كثيرة لمذهبهم , في حين ذهب البعض الأخر من الفقهاء إلى عدم جوازه واستدلوا أيضا بأدلة
ومسألة التقنين حقيقة من القضايا الاجتهادية التي يسوغ فيها الخلاف وبالتالي فلا إنكار على أي من الفريقين المختلفين طبقا لما قرره علماؤنا الأفاضل من أن المسألة الاجتهادية إجمالا لا إنكار فيها على احد من المختلفين
وقد ركزت الدراسة على فكرة التقنين من خلال التعرف على أصل مسألة التقنين عند المتقدمين والفقهاء المجيزين للتقنين والمانعين له وأدلة كلا الفريقين مع الترجيح بين أقوال الفريقين من خلال مناقشة أدلتهم لمعرفة أقوى الأدلة ووجاهتها والتعليلات التي استدل بها أصحابها وسلامتها وقلة الاعتراضات عليها ومناسبة القول للواقع في العصر الحاضر
