Abstract
بات الإرهاب والحرب عليه وقضايا التطرف، والجماعات المسلحة، من المصطلحات المألوفة التي تتردد على مسامعنا ليلا ونهارا، حتى أنها أقضت مضاجع المشتغلين في المجال القانوني حتى يجدوا لها إطارا قانونيا مناسبا. إذ لم يكن خبراء القانون الدولي بصفة عامة ببعيد عن السجال القانوني الذي نتج عنه توجيه سهام النقد إلى اتفاقيات جنيف باعتبارها تقف عاجزة عن معالجة ظاهرة الإرهاب والحرب عليه، التي تعد من التحديات المعاصرة التي تواجه القانون الدولي الإنساني والعلاقة المعقدة بينه وبين القانون الدولي لحقوق الإنسان، حيث إن تخليص ذاكرة المجتمع الدولي من كل شوائب وترسبات قضايا التطرف والإرهاب، أصبح ضرورة وأمرا حتميا من أجل المضي قدما نحو تحقيق الأمن والسلم الدوليين، وبناء علاقة قوية ومتينة بين مختلف مكونات المنتظم الدولي.
Abstract
Terrorism, the war against it, the issues of extremism and armed groups have become
familiar terms that are used to hearing us day and night, and have even groped legal
professionals to find an appropriate legal framework for them. International law experts in general were not far from the legal argument that led to the criticism of the Geneva Conventions as being unable to address the phenomenon of terrorism and the war against it, which is a contemporary challenge to international humanitarian law and the complex relationship between it and international human rights law, as ridding the memory of the international community of all the disadvantages and deposition of issues of extremism and terrorism has become a necessity and imperative for moving towards international peace and
security.
