Abstract
أن وظيفة النظر في الاحباس من الحقوق المشروعة على كل عين موقوفة، يقتضي ممن يثبت له ذلك الحق ان يقوم بإدارة شؤون الوقف، والمتولي لهذا المنصب يسمى الناظر أي ناظر الاحباس او متولي النظر، ومن أهم الواجبات الملقاة على عاتق ناظر الاحباس في الأندلس، هي تولي ادارة الاوقاف او الاحباس وعمارتها واجارتها والدفاع عنها، وتنمية مواردها، وتحصيل غلتها ، وصرفها الى المستحقين، لان معرفة مقدار ريعها وعامرها وغامرها لايتم إلا بذلك، وما ضاع كثير من الاحباس إلا بالإهمال، لذا وجب على الناظر الكد والجد والاجتهاد في الحفاظ على هذه الاحباس سواءً اكانت عامة او خاصة وتنمية مواردها، واموالها وصرف ريعها على الجهة التي يطلبها من اوقفها
Abstract
The function of examining confinement is one of the legitimate rights of each arrested eye, requiring those who prove that right to administer the affairs of the waqf. one of the most important duties placed on the head of confinement in Andalusia, is to take over the management of endowments or confinement, architecture, rent, defend, develop its resources, collect its yield,and disburse it to the beneficiaries, because knowing the amount of its proceeds, age and immersion is not only so,and many of the loss is lost only by negligence, Therefore, the beholder diligence and diligence and diligence in the maintenance of this confinement, whether public or private and the development of its resources and money and the disbursement of its proceeds to the party requested and standing.
