تمثل متطلبات الخصوصية وإعمال العناصر الخاصة بالحق في الخصوصية أحد اهم التحديات التي تواجه الإنسان في ظل ثورة تكنلوجيا المعلومات والتقدم العلمي الكبير الذي ساد مختلف ميادين الحياة الإنسانية والذي القى بضلاله على جوانب مهمة من الحقوق المتصلة بالخصوصيات الخاصة بالفرد.
لقد أصبحت تكنولوجيا الاتصالات، مثل الانتشار الكبير للشبكة الدولية للمعلومات - الإنترنت – والتوسع الهائل في استخدام الهواتف الذكية النقالة والأجهزة العاملة بالاتصال اللاسلكي بالإنترنت، جزءاً من الحياة اليومية. وبإدخال تحسينات جذرية على إمكانية الوصول إلى المعلومات والاتصال الفوري، عززت الابتكارات في مجال تكنولوجيا الاتصالات حرية التعبير ويسرت النقاش العالمي ووطدت المشاركة الديمقراطية، وبالتالي كان هناك ارتباط كبير ما بين تامين سبل الانتفاع من تكنلوجيا المعلومات وضمان الانتفاع الأمن والمستمر بها والإفادة منها كوسيلة لضمان حقوق الإنسان وضمان التمتع بها، مما زاد من أهمية هذه الأليات الأساسية في مجال توفير البيئة الأمنة والمثالية للتمتع بحقوق الإنسان وبشكل خاص حقوق الإنسان الرقمية .

With dramatic improvements in access to information and instantaneous communication, innovations in communications technology have enhanced freedom of expression, facilitated global debate, and strengthened democratic participation,Thus, there was a great correlation between securing ways to benefit from information technology and ensuring safe and continuous use of it and benefiting from it as a means to guarantee human rights and guarantee their enjoyment, which increased the importance of these basic mechanisms in the field of providing a safe and ideal environment for the enjoyment of human rights, especially digital human rights.
