الأمم المتحدة، مصطلح قانوني دولي، يحتل حيز مهم من دراسات القانون الدولي المعاصر ودراسات التنظيم الدولي، اسم تم تداوله بشكل كبير في محيط العلاقات الدولية وفي الساحة الدولية وفي المجتمع الدولي، اسم يحمل في متقرباته الكثير ويقف ورائه الكثير من الأسرار والأفكار والحقائق والوقائع والفرضيات، اسم تباينت بخصوصه الآراء والمدارس الفقهية والمذاهب الفلسفية، تنازعته الرغبات والآمال والتفت حوله الطموحات، إنها ليست مجرد اسم ومجرد أهداف ومبادئ وأجهزة وهيئات، وهي ليست فقط نمط للعمل الدولي المنظم، هي كل ذلك واكثر، الأمم المتحدة وشهادة الميلاد الرسمية لها في عام 1945، هي حقيقة واقعية وهي وجود فعلي وهي بداية النهاية للقانون الدولي التقليدي، وهي انهيار واقعي لمنظومات قانونية دولية أخفقت في ضبط واقع الحياة الدولية، وهي بداية رحيل أفكار الفقهاء والفلاسفة المدافعين عن المذهب الإرادي وعن السيادة المطلقة، هي المؤسسة العالمية التي لم يتوقع لها العالم أن تصمد كل هذه السنين، هي المنظمة التي ما تصور احد أن ينتمي اليها ويدين لها بالولاء أعداد كبيرة من المنظمات الدولية المتخصصة لتشكل ما يسمى بمنظومة الأمم المتحدة أو آسرة الأمم المتحدة، هي المنظمة التي أنجبتها الحروب وأنتجتها المعاناة وأوجدتها الرغبة في العيش المشترك، هي المنظمة التي صدمت العالم بسرعة نموها، وقيادتها للشأن العالمي، هي المنظمة التي انقسمت حولها الآراء في مدى نجاحها في تحقيق مقاصد حفظ الأمن والسلم الدوليين، واختلف الكثيرون حول قدرتها على التوفيق بين مصالح الدول العظمى، هي من قدمت طرح جري في تلك الحقبة التاريخية من سيادة الحروب العالمية، لتعلن صراحة تحريمها لاستخدام القوة المسلحة في تسوية المنازعات الدولية أو التهديد في استخدامها، هي منظمة بتركيب خاص وببناء مختلف تعمل بمفاهيم مختلفة وبأبعاد متعددة وبجوانب متباينة، منظمة اعلى من المنظمات الدولية واسمى من غيرها، بميثاق لا يصنف بانه اتفاقية دولية عادية، وباختصاصات لا نظير لها في تجارب التنظيم الدولي. The United Nations, an international legal term, occupies an important space in studies of contemporary international law and studies of international organization. It is a name that has been widely circulated in the context of international relations, in the international arena, and in the international community. It is a name that carries in its approximations many secrets, ideas, facts, facts, and hypotheses. A name with regard to which opinions, schools of jurisprudence, and philosophical sects differed. It is the organization that was born of wars, produced by suffering, and created by the desire for coexistence. It is the organization that shocked the world with its rapid growth and leadership in global affairs,It is the organization around which opinions were divided regarding the extent of its success in achieving the goals of maintaining international peace and security, and many disagreed about its ability to reconcile the interests of the great powers. It was the one that presented a proposal that was prevalent in that historical era regarding the dominance of world wars, to explicitly declare its prohibition of the use of armed force in settling... International disputes, or the threat in their use, are an organization with a special structure and a different structure that operates with different concepts, multiple dimensions and different aspects. An organization that is higher than international organizations and higher than others, with a charter that is not classified as an ordinary international agreement, and with specializations that are unparalleled in the experiences of international organization.
