الحمد لله ، والصلاة والسلام على رسول الله ، وعلى آله وصحبه أجمعين ...
أما بعد...
لا يخفى على كل ذي لب أن صوم شهر رمضان ركن من أركان الإسلام، وفرض من فروض الله، معلوم من الدين بالضرورة.
ويبدأ وجوب صوم شهر رمضان إذا عُلِم دخوله، ولا يثبت دخول شهر رمضان إلا بأحد أمرين :
الأول : رؤية هلال رمضان وذلك بإجماع المسلمين؛ لقول الله تعالى: ﭽ ﮤ ﮥ ﮦ ﮧ ﮨ ﮩﮪ ﭼالبقرة: ١٨٥ .
وثبت عن النبي – صلى الله عليه وسلم – أنه قال : " صوموا لرؤيته وأفطروا لرؤيته ، فإن غُبِّيَ عليكم فأكملوا عدة شعبان ثلاثين " . أخرجه البخاري رقم (1909) ، (1081) .
ويكفي في ثبوت الرؤية إخبار عدل واحد من المسلمين برؤيته له ، على الصحيح ؛ لقول ابن عمر – رضي الله عنهما - : " تراءى الناسُ الهلال ، فأخبرت رسول الله – صلى الله عليه وسلم – أني رأيتُهُ ، فصام وأمر الناس بصيامه " أخرجه أبو داود ( 2342) ، وابن حبان (2127 ) .
الثاني : إكمال عدة شهر شعبان ثلاثين يوما : وذلك حينما لا يُرى الهلالُ ليلةَ الثلاثين من شعبان مع عدم وجودِ ما يمنع الرؤية من غيم أو قتر أو مع وجود شيء من ذلك ؛ لقوله – صلى الله عليه وسلم - : " الشهر تسع وعشرون ليلة ، فلا تصوموا حتى تروه ، فإن غُمّ عليكم فأكملوا العدة ثلاثين " أخرجه البخاري (1907) ، وكذلك مسلم (1080) .
يقول سماحة الشيخ / عبد العزيز آل الشيخ مفتي عام المملكة العربية السعودية ورئيس هيئة كبار العلماء – حفظه الله - : ولا يثبت الشهر بغير هذين الأمرين ، فلا عبرة بقول أهل الحساب والفلك في هذا الأمر ، فإنه أمر شرعي ينبني عليه عبادات للمسلمين ضبطها الشارع بضوابط لا يجوز لنا تجاوزها ، وقد دلت الأدلة على أن ثبوت شهر رمضان لا يكون إلا بالرؤية الشرعية المعتبرة ، أو بإكمال عدة شعبان ثلاثين يوما .
ولم يأت دليل يعلق دخول هذا الشهر بالحساب ، بل قد صح عن النبي – صلى الله عليه وسلم – ما يدل على عدم اعتباره ، ففي صحيح البخاري عن ابن عمر – رضي الله عنهما – عن النبي – صلى الله عليه وسلم – أنه قال : " نحن أمة أمية لا نكتب ولا نحسب ، الشهر هكذا وهكذا " أخرجه البخاري (1913) ، وكذلك مسلم (1080) .
يعني مرة تسعة وعشرين ومرة ثلاثين ، فنفى المعرفة بالحساب وظاهره نفي تعليق الحكم ، يوضح ذلك ما أخرجه البخاري أيضا أن رسول الله – صلى الله عليه وسلم – قال : " فإن غُمي عليكم فأكملوا عدة شعبان ثلاثين " أخرجه البخاري (1907) ، ومسلم ( 1080 ) .
بل أن بعض العلماء قد نقل إجماع السلف على عدم اعتبار الحساب في ثبوت شهر رمضان ، وإذ قد ظهر ذلك فإن الاعتماد على الحساب في إثبات الشهر عمل غير مشروع لعدم الدليل عليه ، مع مخالفته لظواهر الأدلة وما نقل من إجماع سلف الأمة ، فيكون القول به مردودا على صاحبه ، لقول النبي – صلى الله عليه وسلم – في حديث عائشة – رضي الله عنها - : " من عمل عملا ليس عليه أمرنا فهو رد " أخرجه مسلم ( 1718) .
والجاليات المسلمة في البلاد الكافرة إن تمكنوا من تحري رؤية هلال شهر رمضان فهو المتعين ، وإن لم يتمكنوا فالواجب عليهم أن يتبعوا أقرب بلد مسلم يعمل بالرؤية الشرعية ، ولا يجوز لهم العمل بالحساب بحال كغيرهم من المسلمين في بلاد الإسلام . ( مجلة البحوث الإسلامية عددها (61) ، ص 10 ، 11 بتصرف ).

It begins with the obligation to fast the month of Ramadaan if he knows of his entry, and it is not proven to enter the month of Ramadaan except with one of two things:
The first is to see the moon of Ramadan by the consensus of the Muslims, because Allaah says (interpretation of the meaning):
It is proven that the Prophet (peace and blessings of Allaah be upon him) said: “Fast to see him and break the fast to see him. Narrated by al-Bukhaari (1909), (1081).
It is enough to prove the truth of one of the Muslims by seeing him, on the right; to say Ibn Umar – may Allah be pleased with them -: “People saw the crescent, and I told the Messenger of Allah – peace be upon him – I saw him, and fast and ordered people to fast” 2342) and Ibn Hibban (2127).
The second is the completion of the month of Shaaban for thirty days. This is when the moon does not see the night of the 30th of Sha’baan, with nothing to prevent the vision from Ghaim or Qatr, or with some of that, because the Prophet (peace and blessings of Allaah be upon him) said: “The month is twenty-nine nights. Do not fast until you see it, but it is a cloud for you to complete the ‘thirty. “Narrated by al-Bukhaari (1907), as well as Muslim (1080).
Sheikh Abdul Aziz Al-Sheikh, the Grand Mufti of the Kingdom of Saudi Arabia and Chairman of the Council of Senior Scholars (may Allah preserve him) said: The month is not proven without these two things. There is no way to say the people of arithmetic and astronomy in this matter. The evidence indicates that the proof of the month of Ramadaan can only be done with the view of the shar’i vision, or by completing the number of Sha’baan for thirty days.
The Prophet (peace and blessings of Allaah be upon him) did not say that he did not consider it. In Saheeh al-Bukhaari, Ibn Umar (may Allaah be pleased with him) said that the Prophet (peace and blessings of Allaah be upon him) said: “We A nation of illiteracy, we do not write or calculate, the month is so and so. “Narrated by al-Bukhaari (1913), as well as Muslim (1080).
This is explained by al-Bukhaari also that the Messenger of Allah – peace and blessings of Allah be upon him – said: “My reward for you, complete the several Sha’baan thirty” narrated by al-Bukhaari (1907) and Muslim (1080) ).
Some scholars have even quoted the consensus of the Salafis as not to consider the account as evidence of the month of Ramadan. As it appears, relying on the account to prove the month is illegal because it is not proof of it, while it contradicts the evidence and the consensus of the nation’s predecessors. On the owner, according to the Prophet – peace be upon him – in the hadeeth of Aisha – may Allah be pleased with her: – “Whoever does an act that is not our order is a response” Narrated by Muslim (1718).
And the Muslim communities in the country who disbelieve if they were able to investigate the vision of the crescent of Ramadan it is necessary, and if they can not have to follow the nearest Muslim country working with the vision of legitimacy, and may not work in the case as well as other Muslims in the country of Islam.
