تُثير أحوال الإستشارة التي يُقدمها مجلس شورى الدولة العراقي للإدارة وطبيعتها ونطاقها عدداً من الإشكالات القانونية، على الرغم من الإتفاق على أهميتها، سواء في ذلك لمشروعية العمل الإداري وفعاليته، أم لحماية حقوق الأفراد من خلال تبصير الإدارة بمشروعية وعواقب أفعالها. ولا يقف دور المجلس عند تقديم الإستشارة للإدارة بل أنّه يُعدّ مُستشاراً أميناً للجهات العليا في الدولة.
وإذا كان تدخل المشرع يؤثر حتماً في طبيعة الإستشارة التي يُقدمها المجلس للإدارة، إلاّ أنّ الثقة والإستقلالية التي يتمتع بها المجلس وإختصاصه يجعل لآرائه حُجية أدبية، تدفع الإدارة الى وضعها في الحسبان، بل وغالباً ما تلتزم بها، عند قيامها بالتصرف.
ويُمارس مجلس شورى الدولة تقديم جميع أنواع الإستشارة، سواء أكانت إلزامية أم إختيارية أم مُقيدة. وللمجلس إبداء الرأي في جميع الموضوعات التي تُعرض عليه ما عدا القيود التي نص عليها القانون، مع ملاحظة أنّ المجلس قد وسّع من هذه القيود.

The Iraqi State Consultative Council gives consultations in several statuses, with various natures, and scopes, all of which raises many legal problems. And it’s agreed on their importance, whether for the legitimacy and effectiveness of administrative work or for the protection of the rights of individuals, by clarifying the legitimacy of administration actions and their consequences.
Noticing that the role of the Iraqi Council does not stop at the verge of administrative field, but it is considered as a trusted adviser to the highest authorities in the state. And despite the effect of the legislator's intervention on the nature of the advice the Council gives to the administration, but, its independence, and its competence make its consultations of a literary binding authority that oblige the administration to consider them, and often abide by them when acting.
Moreover, the Iraqi State Consultative Council exercises all types of counseling, whether compulsory, optional, or restricted. The council may express its views on all subjects presented to it, except for the restrictions stipulated by the law, noting that the Council itself has expanded these restrictions.
