تتناول الدراسة نص المرسوم الخاص باستغلال العقارات الوقفية الموجهة لإنجاز مشاريع استثمارية) الذي والذي جاء لينظم موضوع الاستثمار في الأوقاف، وتطرح الدراسة إشكالية النصوص الواردة في هذا المرسوم هل يمكنها أن تستدرك نقص التشريعات في مجال استثمار الوقف و يمكنها أن تفعل الوقف في مجال الاستثمار والتنمية ؟ وتجيب الدراسة عن الإشكالية من خلال فحص ومعالجة مضمون هذا المرسوم التنفيذي، باستخدام المنهح الوصفي التحليلي بتحليل مضمون نص المرسوم ومقارنته مع النصوص التي تشكل الخلفية التشريعية له، وفق خطوات التحليل المنهجي لأي نص قانوني وفق التسلسل المنهجي الذي تقوم عليه الدراسة في ثلاث ملفات وتخلص الدراسة إلى أن: المرسوم إجابة على ما طرحه عدة باحثين في كون أكبر تحد للوقف في الجزائر هو غياب المراسيم التي تنظم الاستثمار في الوقف كما أن المرسوم يشجع المستثمرين على الاستثمار في الأملاك الوقفية.

The study deals with the text of the decree on the exploitation of waqf properties directed to the completion of investment projects, which came to regulate the subject of investment in endowments, and the study raises the problem of the texts contained in this decree can realize the lack of legislation in the field of investment waqf and can do the waqf in the field of investment and development? The study responds to the problem by examining and processing the content of this executive decree, using the descriptive analytical finish by analyzing the content of the text of the decree and comparing it with the texts that form the legislative background of it, according to the steps of systematic analysis of any legal text according to the systematic sequence on which the study is based in three files. The study concludes that: The decree is an answer to what several researchers have put forward in the fact that the biggest challenge to stop in Algeria is the absence of decrees governing investment in waqf, and the decree encourages investors to invest in waqf properties.
