الصندوق الاستثماري نظام استثماري جماعي تعاقدي يتعلق بالاصول المنقولة او غير المنقولة، لانه عبارة عن تجميع لاموال الاشخاص يكون الغرض منه تمكين الاشخاص والمشاركين في هذا النظام من الحصول على الارباح التي قد تنشأ عن حيازة او امتلاك او ادارة او التصرف في تلك الاصول.
اذ تعد الاصول المكونة للصندوق الاستثماري مملوكة بشكل جماعي للمستثمرين أي توفر الملكية الجماعية للصندوق، حيث ان لكل منهم حصة مشاعة من صافي تلك الاصول بمقدار ما يحمله من الوحدات الاستثمارية حيث تحولت نقود المستثمرين الى حصة شائعة في مكونات الصندوق.
ولاجل انشاء الصندوق الاستثماري لابد من معالجة جملة من الاجراءات الخاصة بالتاسيس، وعند حصول اية منازعة يحتاج الامر الى وسائل اثباتها للحكم، فهي اما ان تكون صادرة عن اشخاص القانون العام او صادرة عن اشخاص القانون الخاص لذا تكون الوثائق الصادرة من الصندوق اما وثائق رسمية او عادية.
وبهذا تكتسب دراستنا هذه اهمية خاصة كونها الدراسة الفريدة من نوعها التي تتناول بحث ماهية وثائق الصندوق الاستثماري سواء الرسمية منها ام العادية.
فضلا عن التطرق بمعرفة سبل انقضاء تلك الصناديق الاستثمارية وبيان حالات انقضائها الطبيعية وغير الطبيعية مع معالجة التطبيقات القانونية للصناديق الاستثمارية في بعض الدول سواء العربية ام الاجنبية.
Abstract
Investment Fund collective investment system contractual regard to assets movable or immovable, because it is a compilation of money people, the purpose of which is to enable people and participants in this system to obtain profits that may arise from the acquisition, ownership or management or disposition of those assets
As are assets consisting of investment fund owned by investors collectively provide the collective ownership of the Fund, as each of them a common share of the net these assets to the extent that the magnitude of the investment units as investors shifted money into a common share in the components of the fund
And for the establishment investment fund must address a series of procedures for Baltacis, and when you get any dispute need to be called means prove the rule, they are either issued by people public law or issued by people private law and so could be documents issued by the Fund either official documents or unusual.
With this gain of this study is particularly important as the study of unique addressing discuss what mutual fund documents, whether official or ordinary.
As well as the address of knowing how the expiration of such investment funds and a statement terminating cases of natural and non-natural with legal processing applications for investment funds in some countries, whether Arab or foreign.
