Abstract
غني عن البيان ان التطور الحاصل في مسائل الاتصالات الحديثة واجراء المعاملات والعقود الالكترونية قد استلزم تطوير اسلوب خاص في فض النزاعات الناجمة عنها وذلك بتطوير اسلوب التحكيم ليتناسب ويتلاءم مع هذه التطورات السريعة التي فرضت نفسها من دون سابق انذار , فكان التحكيم عن بعد الاسلوب الامثل والاكثر ملائمة لهذه البيئة الافتراضية ,حيث اصبح حقيقة واقعا مفروضا ومتسارعا لا يمكن اغفاله, لذا كان يتعين على عمليات التحكيم التقليدية ان لا تقف مكتوفة الايدي امام هذا التطور, حيث ادى استخدام الانترنت على نحو واسع في مجالات المعاملات القانونية الى خلق نوع جديد من المعاملات تمثلت بالمعاملات الالكترونية, فجاء التحكيم عن بعد ليسهم في حل بعض النزاعات وليتناسب مع هذا التطور السريع , لذا نوصي المشرع العراقي خاصة بضرورة إصدار تشريع خاص يعالج التحكيم في المواد المدنية والتجارية والادارية في العراق ويضم التحكيم الداخلي والدولي اسوة بالقوانين العربية الاخر ,ويواكب التطور الحاصل في عالم التحكيم, ويحمل في طياته نصوصا خاصة تعالج التحكيم التجاري الالكتروني.
Abstract
It goes without saying that the development taking place in the issues of modern communications and conducting electronic transactions and contracts has necessitated the development of a special method for settling disputes arising therefrom by developing the method of arbitration to suit and fit these rapid developments that imposed themselves without prior warning, so remote arbitration was the best and most appropriate method. For this virtual environment, where it has become an imposed and accelerated reality that cannot be overlooked, so the traditional arbitration processes had to not stand idly by in front of this development, as the use of the Internet on a large scale in the areas of legal transactions led to the creation of a new type of transactions represented by electronic transactions Remote arbitration came to contribute to resolving some disputes and to suit this rapid development, so we recommend the Iraqi legislator in particular the necessity of issuing a special legislation dealing with arbitration in civil, commercial and administrative matters in Iraq and including internal and international arbitration, similar to other Arab laws, and keeping pace with the development taking place in the world of arbitration. It contains special texts dealing with electronic commercial arbitration.
