يعتبر إتفاق باريس حول التغيرات المناخية لعام 2015 من الإتفاقيات البيئية المتعددة الأطراف التي تشتمل على أحكام تنتمي إلى القانون الصلب و أخرى إلى القانون المرن. حيث حددت المادة الثانية منه الهدف العام لتخفيض الغازات الدفيئة، و جاءت بصيغة عامة و غير دقيقة، إلا أن إستقراء هذه المادة على ضوء مواد أخرى من الإتفاق نجد أنها تنص صراحة على إلتزامات لتحديد مساهمات محددة وطنيا لتحقيق الهدف الذي جاء بموجب المادة الثانية من الإتفاق.
Abstract
The Paris agreement on climate change 2015 is considered one of the multilateral environmental agreements that include provisions belonging to both hard law and soft law. The article 02 of this Agreement sets the general goal of reducing greenhouse gases, but it is framed in a general and vague manner. However, when interpreting this article in light of other provisions in the agreement, it becomes clear that it explicitly outlines commitments for countries to determine their Nationally Determined Contributions (NDCs) to achieve the goal set in the article 02 of this agreement.
